MIDDLETOWN MAN CHARGED IN BEATING DEATH
October 20, 2009

City of Middletown and State Police have charged a man in the October 10th beating death of a Middletown resident.

Alvaro Cruz, 25 of 14 Hillside Ave Middletown, was charged late last night with Manslaughter 1st degree, a Class “B” felony for the death of Juan Carlos-Garcia. Garcia was assaulted at approximately 2:25 am October 10 outside of the Perla Escondida Mexican Restaurant at 133 Wickham Ave. After the assault the victim left with friends. At approximately 3:50am the victim was brought to Orange Regional Medical Center by a friend. He was later transferred to Westchester Medical Center in Valhalla where he died on October 17th.

Cruz is employed as a barber at the Wills Barber Shop on Wickham Ave. He was previously arrested in Middletown on September 17, 2005. In that incident he was involved in a fight at the Downtown Tavern at 18 North Street. He was one of three persons arrested for Disorderly Conduct. He later pled guilty to that charge in Middletown City Court and paid a $150.00 fine.

“The arrest of Alvaro Cruz would not have been possible without the exhaustive attention to detail exhibited by the investigators and detectives”, said Middletown Police Chief Matthew Byrne. “They kept chipping away until the details became clearer. Mr. Cruz is the first arrest in this case. We are seeking to make more arrests in the future until everyone involved is held accountable.”

Cruz is currently being held in the Middletown Police lockup awaiting arraignment later today in City Court.

The investigation is continuing. Anyone with information is asked to call Middletown police at 343-3151, via the anonymous tip line at 1-877-341-TIPS or online at www.middletownpolice.com. All calls and tips will be treated confidentially.
